YOU MAY BE ENTITLED TO A CASH PAYMENT FROM A CLASS ACTION SETTLEMENT IF YOU SCANNED YOUR FINGER TO CLOCK-IN AND/OR CLOCK-OUT, AND/OR TO LOG IN TO A POINT-OF-SALE SYSTEM, WHEN WORKING FOR KENKRIS, INC. IN THE STATE OF ILLINOIS BETWEEN AUGUST 22, 2017, AND JANUARY 23, 2024.

  • A settlement has been reached in a class action lawsuit between Kenkris, Inc. (“Defendant”) and certain individuals who used fingerprint scanners to clock-in and/or clock-out, and/or to log in to Point-of-Sale systems, while employed by Defendant in the State of Illinois between August 22, 2017 and January 23, 2024. The lawsuit alleges that Defendant violated an Illinois law called the Illinois Biometric Information Privacy Act (“BIPA”) when it allegedly collected, captured, obtained, used, disclosed, or possessed individuals’ biometric data through their use of fingerprint scanners to clock-in and/or clock- out, and/or to log in to Point-of-Sale systems, without complying with the law’s requirements. The case Bird, et. al. v. Kenkris, Inc., Case No. 2022-LA-7, currently pending in the Circuit Court of Jasper County, Illinois. The proposed Settlement is not an admission of wrongdoing by Defendant, and Defendant denies that it violated the law. The Court has not decided who is right or wrong. Rather, to avoid the time, expense, and uncertainty of litigation, the Parties have agreed to settle the lawsuit. The Settlement has been preliminarily approved by a court in Newton, Illinois.
  • You are included in the Settlement if you scanned your finger to clock-in and/or clock-out, and/or to log in to a Point-of-Sale system, when working for Defendant in the State of Illinois between August 22, 2017, and January 23, 2024.
  • If the Court approves the Settlement, members of the Class who submit valid claims will receive an equal, or pro rata, share of a $397,100.00 settlement fund that Defendant has agreed to establish. Each individual who submits a valid claim will receive a portion of this fund, after all notice and administration costs, the incentive awards, and attorneys’ fees – if approved by the Court – have been paid. Payments are estimated to be $580.00 for each class member.
